The state filed a new motion Friday for the Brandi Weidner trial approaching in two weeks.
Weidner is accused of hitting and killing Gunnar Mcneil in 2015.
She's currently charged with an accident involving death.
The motion filed by the state wants to classify the car she was driving as a deadly weapon.
There was no ruling on that motion in the pre-trial hearing.
According to the court Weidner's trial is scheduled to begin December 11th and is estimated to take 2 to 3 days.
