A murder trial set to start Oct. 16 has been pushed back a day.

Attorney's in the case of Jason Scott Little, 30, met in court for a final pre-trial meeting before the trial is set to begin.

However Little's attorney brought forward a motion to the judge requesting to dismiss for failure to provide a speedy trial.

Little's case has been ongoing since 2015.

Little's attorney argued new evidence was brought forward Friday.

Evidence which should've been brought forward months, if not a year ago in the case, according to his attorney.

Little is accused of fatally shooting Bertha Gonzalez on Martin Luther King Drive in February 2015.

Attorneys in the case will now go over evidence and motions presented to the judge on Oct. 16 with the jury selection set to begin Oct. 17.
